
What to do in a case of damage?
Cases of damages in Shipping cannot be
avoided. This main connecting theme will not help you to avoid
such claims but it can expedite the claims handling and will
avoid unnecessary waiting periods. Therefore we recommend that
you follow our guidelines in this connecting theme in order to
avoid any misunderstanding in the claims report and time of

Please take care that the claim will be
surveyed by an expert, before repairs will be done. If
this should not be possible, please try to keep the
damaged parts in order to present them subsequently to
an expert.

Furthermore you have to provide the
appointed expert or us with a damage report, which
should contain the following points:

- Short
description of the accident

In order to guarantee a smooth claims
handling, please provide the expert with all
claims-related documents. |
Third Party Liability Claims:
If a Third Party should be affected as part of
the claim, then kindly observe and adhere to the following:

Never accept an admission of guilt |

Never give any comments to the opposing
party regarding the claim |
 |
If you want to hold the opposing party
responsible for the claim, please use the following
wording:
"To Whom it may concern:
Herewith I hold you responsible for the damage and/or
costs, which have been inccurred to me or could inccurr
in the future due to the claim…" |

In case you have to sign something,
please use in addition to your signature the following
wording:
"Without prejudice only confirm receipt" |
